Title 42 was originally a health measure instituted by the Centers for Disease Control under the Trump administration to "contain" the coronavirus. Instead, the Department of Homeland Security, not surprisingly, weaponized the rule by quickly turning away as many migrants as possible without offering them an asylum hearing.
Unfortunately, the Biden administration has not ended the rule.
Of the more than 1.1 million migrants who crossed the border in 2021, the Biden administration used Title 42 to expel a horrifying 84 percent, according to The New York Times. Title 42 allows immigration officials to reject people at an inhumane rate—a person every 15 minutes—as opposed to spending the typical two hours to ask questions and file paperwork.
Many of these people included the world's most marginalized: transgender individuals, parents with small children fleeing violence in Central America, and political refugees from countries such as China and Cuba.
Seeking asylum from violence and political persecution is a human right, and the United States was built on these principles.
